Upon police arrival, they found Mares with severe injuries, and despite life-saving efforts by fire personnel, he was pronounced dead at the scene. He was treated for his injuries at a local hospital before being taken into custody on multiple charges, including manslaughter and fleeing the scene of a fatal accident.

Sgt. Robert Scherer of the Phoenix police provided details about the case, noting that Smith's vehicle remained at the scene.
